Oh yes, this MK4 doesn't come with sun glasses and donuts, so if u just want MK4, don't buy Gantry version.

Rajat Gupta faces jury in insider trading case

NEW YORK (Reuters) - Barely a day went by at the insider-trading trial of multimillionaire hedge-fund founder Raj Rajaratnam a year ago without mention of Rajat Gupta, a boldface name in business and charity circles.

On Monday in the same federal court in New York, it will be Gupta's turn to go on trial. The former Goldman Sachs Group Inc and Procter & Gamble board member is accused of leaking stock secrets to Rajaratnam, his erstwhile friend and business associate who was convicted and is now in prison.

But while prosecutors have called Gupta the "illegal eyes and ears" for Rajaratnam, this is a very different case. At Rajaratnam's trial, jurors spent weeks listening to the Galleon Group founder discussing stock trades on calls secretly recorded by the FBI. With Gupta, prosecutors have no direct conversations on tape related to the trades central to their case.

One of the government's core allegations is that Gupta tipped Rajaratnam to Berkshire Hathaway Inc's $5 billion investment in Goldman during the 2008 financial crisis and Goldman's surprise fourth-quarter loss that year.

Gupta, 63, has pleaded not guilty. His lawyers have argued that others may have leaked information about Goldman to Galleon and that Gupta, who once led management consultant McKinsey & Co, had no reason to illegally spill corporate secrets.

"This is a classic reasonable doubt case," said Tom Dewey, a partner at law firm Dewey Pegno & Kramarsky in New York, who is not involved in the case. "The core defense message will be: 'There is just not enough evidence.'"

Gupta also is charged with providing non-public information to Rajaratnam in 2008 and 2009 about P&G.

A jury of 12 and four alternates will be chosen on Monday for the trial before U.S. District Judge Jed Rakoff, who expects it to last about three weeks. Opening arguments from Assistant U.S. Attorney Reed Brodsky and defense lawyer, Gary Naftalis, could start later Monday.

Gupta is charged with five counts of securities fraud and one count of conspiracy. If convicted, he faces up to 25 years in prison, though such a long sentence would be unlikely. Rajaratnam was handed an 11-year term in October, the longest for insider trading in the United States, after being overwhelmingly convicted on 14 criminal counts.

DECADES AT MCKINSEY

Gupta, the most prominent person indicted in the government's insider-trading crackdown, has had a remarkable fall from grace. Born in India, he earned an MBA from Harvard Business School and spent 34 years at McKinsey, serving as its global head for nine years. He retired in 2007.

He joined Goldman's board in 2006 and left in May 2010, seven months after Rajaratnam's arrest. Gupta, who was arrested last October, was also formerly a director at P&G and American Airlines Corp.

Naftalis has touted Gupta's charity, particularly his work to combat AIDS, malaria and tuberculosis, to rebut any possible government argument that he was motivated by money.

"He has had a wonderful, blameless life and out of the clear blue sky in the seventh decade of his life he decides to become a criminal?" Naftalis said at a pre-trial hearing.

Naftalis fought unsuccessfully to exclude three wiretaps between Rajaratnam and two traders that could implicate Gupta. But the judge said his ruling was not final.

Naftalis has not said if Gupta will testify in his own defense. Some high-profile witnesses could take the stand including Goldman Chief Executive Lloyd Blankfein, who also testified at the Rajaratnam trial as a government witness and said Gupta breached his fiduciary duty to the investment bank.

The case is USA v. Gupta, U.S. District Court for the Southern District of New York, No. 11-907.

They are the 85 latest inductees to the National Technical Honor Society at BOCES? Tech Center in Yorktown. The new inductees, and graduating seniors who received?their honorary shawls, were honored at a ceremony on BOCES? Yorktown campus Thursday.

To be nominated, the students, all of whom attend technical and career classes at BOCES, had to maintain a 90 or better average in their course of study at Tech?and an 80 or better at their home school district. In addition to scholarship inductees had to exhibit character, skill and leadership.

?Whether they are framing house in Carpentry, saving a tree in Urban Forestry or comforting a child in Early Childhood Education,? Tech students have an?advantage because they have been taught by excellent teachers, said Danielle Settembre, a senior in the Cosmetology program.

Millions of early risers in Asia turned their attention skyward to view a rare "ring of fire" eclipse as it crossed their skies Monday morning.

The annular eclipse, in which the moon passes in front of the sun leaving only a golden ring around its edges, was visible to wide areas across China, Japan and elsewhere in the region before moving across the Pacific to be seen in parts of the western United States.

PHILADELPHIA (CBS) ? It was born in a Harvard dorm, spreading like wildfire through colleges across the country. Now, after its IPO, Facebook is worth $104 billion.

For Wall Street deal-makers trading shares of FB (the social network?s ticker symbol) this morning, the price was set at $38-a-share, but was expected to sky-rocket from there.

It would be a good idea to be extremely cautious with this investment.

Many industry experts believe Facebook will be just as popular as or even more popular than the Google IPO as far as Wall Street is concerned. Sheyna Steiner, an investigative reporter for BankRate.com, says there?s a split with investors on who will buy and who will wait.

?The Motley Fool did a survey asking everyone if investors are going to buy Facebook and it was mostly novice investors who said they were very interested in buying shares. People who have a lot of experience investing said that they would probably sit it out. And that was like two people out of 10 who are very experienced versus twice that for novice investors.?

Steiner says just because you like the website, it?s no reason to buy into the IPO.

?A lot of critics have said that Facebook might not be worth what it?s currently valued at.? And you really have to do your homework.? And look at how it?s valued today versus the earnings for the past year and decide if you think they are going to live up to their sales pitch or if they?re not.? It really does take homework; not whether you like the website or not.?

Steiner warns the volatility of IPO?s may be unexpected by the novice investor. Critics contend the company is overvalued. You?d be advised to read the prospectus carefully.

Candidates fight for "change" vote in Dominican election

SANTO DOMINGO (Reuters) - Voters in the Dominican Republic's presidential election on Sunday will choose between two candidates vying to be seen as agents of change, even though one represents the ruling party and the other is a former president.

Making the choice even harder, both candidates represent center-left political parties in a race devoid of major ideological differences and lacking a conservative option.

Polls show Danilo Medina, 60, of the ruling Dominican Liberation Party (PLD), leading by a comfortable margin of 5 to 10 percentage points over Hipolito Mejia, 70, who is hoping to return to power for the opposition Dominican Revolutionary Party (PRD) eight years after a failed re-election bid.

"There isn't a young, fresh, new voice," said Eric Farnsworth, a Latin America expert at the Council of the Americas in New York. "So what you have is both candidates trying to position themselves as the one who is most competent and trustworthy to run the government."

While the Dominican Republic is far wealthier than Haiti, its poor neighbor on the island of Hispaniola, many Dominicans still struggle to satisfy basic needs, prompting some to seek a better life by slipping in to nearby Puerto Rico, a U.S. territory.

The Dominican Republic is a popular resort spot, famous for its white sandy beaches and golf courses, but it also is the leading Caribbean transshipment point for South American drugs destined for the United States and Europe.

FIRST LADY RUNNING FOR VP

Medina, a chemical engineer and co-founder of the PLD, is a former minister of the presidency of the current administration of President Leonel Fernandez, 58, a New York-raised lawyer and academic who is barred from running again after serving two consecutive four-year terms.

Fernandez's wife, Margarita Cedeno, is running as Medina's vice president. Popular with women voters, Cedeno, a 44-year-old mother of two young daughters, used her position as first lady to work for poverty reduction and children and women's issues.

"She's a strong and independent woman and her support cuts across all ages and classes," said Eduardo Gamarra, a professor at Florida International University in Miami who also serves as Fernandez's political consultant. Medina enjoyed a 20 percent advantage over Mejia among women voters, he said.

Mejia established a large lead early in the race, in part due to government austerity measures in the face of the global economic recession that hit the Caribbean hard.

Mejia burnished his message of change with a populist campaign slogan, "Llego Papa" (Daddy's Here), that promised a better future "for everyone."

Medina hit back with a campaign slogan promising "Cambio Seguro" (Change With Certainty), attacking Mejia's record as president from 2000 to 2004, when a major banking scandal rocked the nation's economy.

While both candidates talk of change, their proposals are vague, referring to the importance of improvements in education and investment in tourism.

REFERENDUM ON CURRENT PRESIDENT

With little to distinguish the two candidates ideologically, the election had turned into a referendum on Fernandez's presidency, Farnsworth said.

"The question is do voters want change, mixed in with a bit more of the same," he added, noting that Medina and Fernandez have worked closely together for decades as disciples of PLD founder Juan Bosch.

Fernandez's popularity sank during the recession as living standards fell but he has bounced back strongly this year, Gamarra said, crediting that in part to the start of a series of public works, including a major expansion of the metro system in the capital, Santo Domingo, inaugurated in February.

Mejia has accused the Fernandez government of using public money for political advantage by over-spending on expensive public works projects in the major cities.

Mejia's campaign repeatedly has attacked alleged government corruption, accusing the PLD of abandoning agriculture in favor of massive food imports to benefit businessmen linked to the ruling party.

Notoriously loose-tongued, Mejia saw his campaign lose steam in recent weeks after a series of gaffes, undermining his working-class support base. In a news conference two weeks ago he said corruption in the country was so bad that housemaids had become so untrustworthy they were capable of stealing food off their employers' dinner tables to take home to their boyfriends.

He also insulted the PRD's president, Miguel Vargas, who he beat in a March primary that Vargas denounced as fraudulent, causing a split in the party.

In April, Mejia declined an invitation to face Medina in what was supposed to the first of two scheduled debates between the leading candidates.

His jokes and musings during TV interviews were a feature of the campaign during which Mejia largely refrained from discussing his policies. He referred journalists to a campaign manifesto booklet, saying, "Read them, they're all in there."

The campaign, which draws to a close Friday, has been relatively peaceful campaign compared to previous ones with two deaths and six injuries reported in clashes between government supporters and the opposition.

Four other minor party candidates are in the election but they drew less than 3 percent in polling.

About 5 percent of the nation's 6.5 million eligible voters live abroad, including 220,000 registered voters in the United States, mostly in the New York area.

A Literary Giant Passes

Dear Friends,

A few days ago I received an email from Distinguished Professor Ray Williams: ?Dear Tim, The major Mexican writer of the twentieth century, Carlos Fuentes, died today in Mexico City. National Public Radio will be airing a piece? Fuentes lectured on the UCR campus? and UCR students have been reading his work since the 1960s. [Former Chancellor] Tom?s Rivera was a great admirer of Fuentes? Our loss of Carlos Fuentes [is] a huge loss for the Hispanic community and readers worldwide??

I could stop writing here, but rather choose to share a few more insights to help understand the magnitude of the man, and the loss.

Carlos Fuentes was a giant of Latin American literature, perhaps the greatest contemporary Latino intellectual and writer to emerge in the Americas. He published more than 30 works.

In addition to his literary career, he was a Mexican diplomat who was sharply critical of his government and authoritarian regimes throughout the world.

His novel The Old Gringo was the first book by a Mexican novelist to become a best seller in the U.S., and was made into a movie with Gregory Peck and Jane Fonda. The novel was inspired by the real-life disappearance of American journalist Ambrose Bierce during the 1910-1920 Mexican Revolution.

In the late 1980s, the University of California Institute for Mexico and the United States (UC MEXUS), which operates out of UCR?s Olmsted Hall, brought him to speak at the University Theatre. He read from his newest novel, Christopher Unborn (an indictment of the corrupt, polluted Mexico City).

Poet and author Rigoberto Gonz?lez, now an associate professor of English at Rutgers, was a freshman at UCR at the time. Professor Gonz?lez blogged earlier this week about that encounter: ?I simply sat there mesmerized . . . His forehead glistened, and the spittle leaping off his lips was made visible in the stage lights. He held a copy of the book in one hand and chopped the air with the other, accentuating his delivery of a lengthy, winding road of sentences.?

Gonz?lez was so taken by the man that he bought paperback editions of two of Fuentes? novels to be signed. ?When I finally had my chance in front of Mr. Fuentes, whatever I had rehearsed to say had flown right out of my head. He appeared broken down, fatigued, but he smiled back anyway? I said to him before I was turned away, ?Yo soy de Michoac?n. Yo tambi?n voy a ser escritor (I?m from Michoacan and I?m going to be a writer too).? He humored me and answered, quite gently, ?Pues, suerte, muchacho. Nada m?s cu?date los dedos (Well good luck kid. Just take care of your fingers).? He raised his hands up to show me and I was stunned: he had crooked index fingers.?

And it was our Professor Williams that many in the media turned to Tuesday for comment and perspective. Professor Williams knew Fuentes well, having hosted him on campus, written about him (The Writings of Carlos Fuentes, University of Texas Press, 1996), and taught his work extensively throughout his career.

Professor Williams remembers Fuentes as an extremely generous person both to Williams personally and to the students who flocked to hear him speak. After one lecture, Fuentes, exhausted from a long day of travel and lecturing, spent hours late in the evening talking with students and signing books. Williams recalls, ?He really made a special effort because there were undergraduates and working people at the event.?

Juan Felipe Herrera, California Poet Laureate and UCR professor of creative writing, said that Fuentes was an essential component of the literary environment when he was a student at Stanford and afterwards. He recalls a man both deeply intense and yet playful, and attributes to Fuentes a broadening of his vision of the Latino experience.

Professor Herrera also incorporated into his writing, especially his poems, Fuentes?s diversity of voices, and his monologues reflecting multiple points of view with their richness of detail and texture and place. Fuentes inspired Herrera to reach for the big picture in his work, and now as California?s Poet Laureate, the gift is now being passed on to others.

My condolences to the Fuentes family, and his friends and colleagues. He was truly a gift.

'11 Nelson runner-up Palmer leads with opening 64

IRVING, Texas (AP) ? Ryan Palmer has been thinking about redemption at the Byron Nelson Championship, and a chance at home to hold up that trophy.

The 2011 Nelson runner-up is off to a good start.

Palmer, who lives in Colleyville not far from the TPC Four Seasons, opened with a 6-under 64 on Thursday to take a one-stroke lead over Marc Leishman and Alex Cejka.

Last year, Palmer birdied the 72nd hole to force a playoff against Keegan Bradley. Palmer then hit his approach into the greenside water to hand Bradley his first tour title.

"I didn't lose it last year by any means," Palmer said. "But to get back in the same setting with the same people watching, here where I live, and just to have that feeling again, this time be the guy standing with the trophy, that's been my focus."

Palmer's bogey-free start came on a relatively calm day. With only a light breeze, 85 players were at par or better in the first round on the 7,166-yard course where Palmer and Bradley finished 72 holes last year at 3-under 277.

Coming off his victory at The Players Championship last weekend, Matt Kuchar overcome an opening bogey and was in a group of seven players at 66.

"Coming off momentum, a little tired," said Kuchar, No. 5 in the world ranking. "It was a whole lot of extracurricular activities out of the norm for me, but I feel good about the round."

Kuchar's approach shot at No. 1 went over the green. He tried to putt it up the hill, but the ball ended up rolling back to his feet, prompting someone in the gallery to say, "I could have done that."

When Kuchar tried again, he got the ball within 4 feet for his only bogey. He was under par to stay after birdies at Nos. 3 and 4.

Bradley, who won the PGA Championship three months after the Nelson, was among 13 players who shot 67. His up-and-down round included four bogeys, five birdies and an eagle.

The only other top 10 player this week is 10th-ranked Phil Mickelson. Back at the Nelson for the first time in five years, he had a 70 with two birdies and two bogeys.

"It's a beautiful day, it's warm, not too hot, the greens are in great shape. They're receptive, you can get the ball stopped," said Mickelson, the 1996 Nelson champ. "Really good opportunity to take advantage of the course, and I just didn't."

The forecast for Friday, and into Saturday, calls for wind steady at 15-20 mph and gusting to 30. That is similar to what happened last year, when scoring conditions quickly got tougher.

"Blow wind, blow! ... Picking up about 12:45 (p.m.) hopefully," said Palmer, who plays Friday morning. "Maybe we can build on (the first round) and set myself up for a big weekend."

It worked so well last year that Palmer is again letting caddie James Edmondson call all the shots at the Nelson. With input from instructor Randy Smith, Edmondson tells Palmer what and where to hit.

They have tried that briefly at other courses without the same kind of success. But the formula works at the Nelson.

"Continuation from last year, that's what's cool," Palmer said. "For some reason, I get in the frame of mind with this golf course and what me and him are doing, and it was the same exact thing. I didn't move until he put the bag down and half of the time he pulled the club out of the bag and handed it to me, I didn't know what the club was."

Former PGA Tour rookie of the year Leishman had two eagles on the back nine, at the 323-yard 11th hole and the 546-yard 16th.

The 65 was his best of 41 rounds this season and lowest since another 65 in the first of his 84 rounds last year, when he slipped to 65th in the FedEx standings ? 45 spots below his standout rookie year of 2009.

"Last year was pretty disappointing. I felt like I got off to a good start and then just about nothing for the rest of the year, really," Leishman said. "It's the first time since I've been a pro that I've struggled for a decent amount of time, just not hitting the ball as well as I would like to, not holing putts. This year, I feel like I'm doing everything a lot better."

The 28-year-old Australian hit 11 of 14 fairways and needed only 24 putts Thursday.

"It probably took longer than I would have liked to have a good round like this," he said.

Panasonic TC-P60ST50


Panasonic plasma HDTVs have a well-deserved reputation for producing very dark black levels, and the TC-P55ST50 continues that trend. The 55-inch plasma panel not only delivers inky blacks, it's out of the box color accuracy is outstanding too. ?At $1,699.99 (list) it's not exactly a steal, but it's not quite as expensive as our reigning Editors' Choice plasma, last year's Samsung PN51D8000 ($2,299.99, 4 stars). The TC-P55ST50 is 3D ready, but it doesn't include glasses, which means you'll have to shell out upwards of $300 for active shutter 3D glasses for a family of four. You'll also pay more to run this set, since like many plasmas, it's not particularly energy efficient.

Editors' Note: This review is based on tests performed on the?Panasonic TC-P55ST50, the 55-inch model in the same series. Besides the screen size difference, the?$1,399.99?50-inch TC-P50ST50 is identical in features, and while we didn't perform lab tests on this specific model, we expect similar performance.

Design and Features
With the TC-P55ST50 Panasonic moves away from the glossy black bezel design used on earlier models, including the?Panasonic P50GT30 ($1,199.99, 3.5 stars) we reviewed last year. This time around the panel is framed by dark gray bezels with a slice of clear trim around the outer edge. A silver brushed aluminum base complements the cabinet and gives the set a touch of elegance. The stand does a fine job of supporting the 61-pound cabinet, but it doesn't swivel.

Behind the right-hand bezel are power, channel, and volume controls and an input select button that doubles as a menu button when you press and hold it. The rear of the cabinet holds all of the I/O connections; three HDMI ports, two USB ports, and an SD card slot are vertically mounted and face left for easy access. Ethernet, TV/antenna, and digital audio out connections sit horizontally under a recessed space notched into the back panel. Here you'll also find a proprietary mini-component video input port for use with the included component dongle. It's odd that Panasonic only equips this model with three HDMI ports considering most HDTVs have four, and in the case of the Sharp Elite Pro-60X5FD ($5,999, 4 stars), five.

The 9-inch remote has 43 buttons and a four-way directional rocker with an Enter button. The main keys have red backlighting that makes them easy to identify in a dark room. The three main keys (Menu, Internet, and Viera Tools) are situated above the rocker assembly, while the number keys and player controls are at the bottom of the remote along with a Help key that launches a built-in user manual.

There's also a 3D button that lets you view 2D content in a simulated 3D mode. As I found with the Sharp Elite Pro-60X5FD, converted 3D picture quality isn't up to snuff compared with true made-for-3D image quality. You don't get the depth and clarity that true 3D offers, and there's a good deal of crosstalk. As with the P50GT30, the P55ST50 does not include active shutter 3D glasses, so be prepared to part with an additional $80 per pair.

Image settings include five preset picture modes (Standard, Cinema, Custom, Vivid, Game) and your basics: Brightness, Contrast, Color, Tint, Sharpness, and Color Temperature. Panasonic's Pro settings allow you to adjust color space and set high and low white balance for reds, greens, and blues. Other Pro settings include panel brightness and gamma adjustment.

The Audio setting menu offers Bass, Treble, Balance, and Surround settings, as well as a volume leveler to keep those pesky commercials from blasting you out of your seat. The TC-P55ST50's 8-Train speaker system, consisting of eight mini domes and a slim but powerful subwoofer, provides a solid wall of sound with a good amount of bass, but the surround effect sounds thin.

Panasonic's selection of Web apps is top notch; streaming movie channels include Vudu, Netflix, Hulu Plus, Amazon Instant video, and CinemaNow, and you get Facebook, Twitter, Skype, and YouTube. Internet Sports channels include MLB, MLS, NBA, NHL, and Fox Sports. The Viera Market Connect menu offers plenty of free services as well as pay-for apps like Uno, Apple Muncher, and Let's Golf 2. And, there's a built-in Web browser.

Performance
I tested the TC-P55ST50 using images from the DisplayMate suite of HDTV diagnostic tests, SpectraCal's CalMAN software, and a CS-200 Chroma Meter. After a basic calibration the panel produced a nice dark black level reading of 0.02 cd/m2, but it could only manage a peak brightness of 85.45 cd/m2, which is tad darker than the P50GT30 (88.58 cd/m2) and quite dim compared with the Samsung PN51D8000 (244.92 cd/m2).

Out-of-the-box color accuracy was excellent. The panel practically hit the CIE (International Commission On Illumination) chromaticity coordinates for red, green, and blue on the nose, as shown in the CalMAN-generated diagram below. More importantly, the P55ST50 delivers an excellent picture; colors popped from the solid black background in the Seasonal Forests chapter of the BBC's?Planet Earth?Blu-ray, and shadow detail was outstanding in the darker Ocean Deep chapter. What's more, there was no evidence of the fringing effect that plagued the P50GT30. Off angle viewing was typical of a good plasma panel. There was no loss of luminance from an extreme side angle and colors remained bright and true.

3D performance was good, but not on a par with our Editors' Choice high-end LCD, the Sharp Elite Pro. I noticed some crosstalk while watching clips from IMAX?Under The Sea 3D, but the artifacts were minor and didn't detract from the overall experience. Panasonic's glasses are lighter than most active shutter glasses, but aren't as comfortable as today's passive glasses, like the six pairs that come with the Editors' Choice Vizio M3D550KD ($1,429.99, 4 stars).

Plasma HDTVs aren't known for energy efficiency, and the P55ST50 is no exception. With Power Saving mode disabled, the set used 305 watts during my testing; that number dropped to 245 watts with it enabled. The P50GT30 averaged 225 watts, while the Samsung PN51D8000 used 105 watts in Standard mode. If energy efficiency is a deal breaker, consider an LED-backlit LCD model like the LG 55LM6700 ($2,299.99, 4 stars), which only consumed 67 watts.

Conclusion
The Panasonic P55ST50 is a tastefully designed 55-inch plasma HDTV that delivers very accurate colors, deep dark blacks, and wide off-angle viewing. Its $1,700 price tag is not unreasonable considering its performance, but you'll end up spending around $2000 if you need four pairs of 3D glasses. You don't get the brightness and superior image quality of the Samsung PN51D8000, but you do get a slightly bigger screen and a much smaller price tag.
